In answer to: How long can a Realtor legally hold on to earnest money when the buyer has signed a release on a contract?Dear Cindy, You are legally entitled to the EMD to be refunded back to you in full if you back out of the contract for the reasons you state as long as this information concerning the property was not disclosed to you in the first place. There is only one reason that I know of that a buyer forfeits the EMD and that is if the buyer just simply changes their mind, the EMD is then used as liquidated damages because the property was taken off the market and lost the potential of a buyer. You may want to pursue this matter further and I am sorry for your stress, it's not always that way, don't be put off. The EMD will be with a Title Company of Real Estate Attorney. I know in Florida it is illegal on the part of the Realtor to hold onto the EMD so it won't be with them. I wish you all the best in dealing with this situation.

But, there are certain areas of USA that are high turnover tourist spots. This means that you can buy a property and use it as a vacation rental property which will bring you a much higher income than a regular rent income while the market is turning back upward. Please make sure you use a Realtor who knows about this thing. I am originally from UK too and moved here 10 years ago. (Not a Bank anyway) You will have to meet a criteria for the lender to consider a loan and this includes being in regular, steady employment that meets a particular dollar figure according to the sum they will lend you and have a minimum credit score of 620. The only other option probably out there for you right now is seller financing or lease option. There will still be a criteria that you will have to meet and the house owner will take situations into consideration and the interest will be higher, but you do have these options.
