In answer to: When should a promissory note for earnest money be payable (to the escrow company)?
Promissory notes are not my favorite. If they don't have the money now, they may not have it later. You are correct - they will be able to tie up the property and that puts the seller at a disadvantage. No money, no due dilligence period, but they can do all the checking they want while the house is still on the market (the fastest they finish the due dilligence, the faster they secure the house with a signed offer).

I would contact a local real estate company and ask to speak with a Reatlor who specializes in rentals. Google "rental agents" in (the town you are looking in).

In answer to: For the houses/apartments to be rented, are leases required?
The landlord usually determines if there is a lease or if you would be renting on a "month to month" basis. Whatever the situation remember one thing.. it is always better to have agreements in writing. You will have a clear understanding of what is expected of you while you are living there. On a side note... dont be afraid to talk with a local Realtor about the possibility of buying your own house (often it is much easier than people think) and for some reason you cant qualify now, you can set up a strategy to be ready to buy a home in the future. Why pay someones elses mortgage every month when you can own and build equity by paying off your own? I hope the advice is helpful.

In answer to: what does it mean if theres more than one house for sale on the same street?
Great question. After practicing real estate for two decades, I must say this happens frequently. Real estate school even teaches agents to mail to the neighborhood because if one person sells there is a very good chance someone else will sell within the next handful of months. With that said.... there could be a reason why they are selling. It might be a good idea to take a walk around the neighborhood and talk with the neighbors (they will usually tell you all you want to hear). It might also be helpful to go to the town hall and police station and ask the question something like.. "you are thinking of buying a home on a particular street and there are multiple homes for sale.. Do you know of anything going on there now or in the future that would cause people to want to sell? Checking online on the popular town web sites would also be helpful. You can never be too cautious with such a big purchase.

Sorry to hear about that. I would recommend talking with a good Realtor and loan officer to see what your options are. The better the education you receive on buying a home and financing a home, the better the decisions you can make. With the rates so low and house prices so affordable it is an excellent time to buy your first home. However, buying a home is a big decision so don't rush into it just because the landlord you had was a not a nice person. Buing a home is a process and not an event. Good luck.

In answer to: can you buy or sell property without a agent
Excellent question. You do not need a Realtor to sell your house to a relative. A knowledgeable real estate attorney can do it. However, your sale is most likely one of the biggest financial transactions of your life and I would consider it a business transaction (even though you are selling to a relative). Money can do strange things and come inbetween even the closest of family members. With that said, see if you can get a local real estate broker (owner of the company) to cut you a deal by reducing their fee because it should sell quick and without any advertising expense. Hopefully, you can save and be protected.. "just in case" something goes wrong before, during or after you sell it to your relative. As to the audit question, I would contact a CPA
