DIV>General Use Policy
You agree to utilize your account solely for lawful and professional purposes in the real estate field. Homes.com reserves the right in its sole discretion to refuse service as a result of your failure to adhere to any of the policies set forth herein. You are not allowed to display or otherwise reference directly or indirectly any of the following types of content on or in connection with your account:
- Pornographic content
- Racist or hate-related content
- "Warez" sites, including but not limited to any copyrighted software or music files.
- Content relating to circumventing copy protection ("cracks", key codes, serial numbers, decoder chips, etc...).
- Content which violates a federal, state or local law regulation or ordinance.
- Content that in Homes.com's sole discretion reflects or is likely to reflect negatively on Homes.com or on any of the other accounts it hosts.
Without limiting the foregoing, you are also not allowed to link to or otherwise directly or indirectly associate with another website containing or referencing any of the foregoing content.
Use Policy Related to Posting of Real Estate Listings for Sale
To the extent your account is used to post real estate listings, you are also not allowed to do any of the following:
- Posting inaccurate hand entered listings. Selling price and listing details must be kept up to date and accurate at all times and be consistent with information posted at the local MLS (if applicable).
- Posting bogus or fake listings. Listings must be actual listings for sale and accurate in all respects.
- Engaging in the use of "bait and switch" tactics.
- Posting "borrowed" listings. Borrowed listings are defined as listings where either the listing agent and/or broker of record are not the owner of the Homes.com account.
- Using the listing area of your account as a vehicle to promote personal banner ads to Homes.com's distribution partners or to www.homes.com. Listings can only be used to post actual listings for sale.
- Posting sold listings that are not marked as sold within Homes.com listing system. MLS Feed listings are automatically pulled from feed per local and state rules.
- Posting FSBO listings that are not properly marked as FSBO listings with Homes.com's listing system.
- Posting listings not in compliance with any applicable MLS, association or local, state or federal regulations or ordinances including, without limitation, state board of realtor rules and regulations.
Unsolicited Email (spam) and Bulk Email
You may not advertise through unsolicited email, excessive newsgroup cross posting, or off-topic newsgroup posts (collectively "spam"). What is considered spam is determined at the sole discretion of Homes.com. We will make every effort to work with you to ensure that your account is not shut down due to what may be wrongly interpreted as unsolicited mail. Accounts in violation of this policy will be shut down without a refund of any kind. In addition, to protect the quality of service for all of the accounts we host, any bulk emailing that adversely affects the performance of our shared mail servers will be either discontinued or possibly moved to an alternate server if available.
Service Availability
We shall undertake all reasonable efforts to make your Homes.com account available to you at all times but we shall not, in any event, be liable for interruptions of service or down-time of our servers.
