Disclosure is always important and appreciated. I say, "If you have to use a hand tool to remove it, it is Attached". Banks and Appraisers do not like to see this in the offer, as they see it as personal property and can easily be removed from the property. You will need a HIgh Credit Score, not low and at least a 30-40% down payment if you are going to live off of Social Security, pension or 401-K. You will need to begin drawing from your 401-K an amount equal to your new house payment. Please talk to a SC Lender BEFORE you Retire and prepare to get this set up. What area of SC are you moving to? Charleston?Answered: Feb 2, 2016Hello Morgan, Kate's answer is correct. All parties must agree in writing to any changes of these contract up until it closes. I service the Charleston, Dorchester and Berkeley County areas of SC. If your property is in one of these counties, I would be happy to provide you a complimentary conversation with a Real Estate Attorney here in my areas. If your property is listed with a Realtor, they should be able to do that as well. At the closing the Attorney will have you sign a document that states that the buyers have met all of there terms and conditions of the contract on that property. If they have not, you do not close. You can get it worked out and all parties sign as late as at the closing table. If a lender is involved for a mortgage for the buyer, that lender will need to approve any changes made on the HUD/aka Closing Disclosure. Good luck and let us know how it goes. Stand your ground. Have your agent then list what the 4% SC Resident Tax would be for owner occupied. That is easy to obtain from the Tax Assessors office in the county where the property is located.
