About This Lot
The three parcels being sold include two irrigated parcels totaling 4.97 acres and a vacant parcel at the end of Marshall Street measuring 0.2837 acres. Attached are copies of the hay field survey and the Quiet Title Case, which confirms that these lands fall within the old fence line.
We are also selling a 2/7 interest in the Tatman Ditch Water Right. This water flows through the Delisa Ditch, which is 100% owned by us and will be transferred along with the irrigated parcels. However, the Delisa Ditch was damaged, and two-thirds of its length needs to be repaired to ensure proper water delivery to the parcels.
Water from the Tatman Ditch is delivered into the Delisa Ditch and historically distributed based on a set schedule (the 3/7 interests being sold). Under this agreement, the Delisa Ditch received water on Tuesdays and Fridays—documentation is attached. In practice, however, owners have cooperated to distribute water based on crop needs, ditch capacity, and delivery efficiency.
The Tatman Ditch water right provides water for approximately 180 days each year, from March 15 to November 1, with diversions outside this range when conditions allow. Peak flow at the Tatman headgate (photo available) is limited to 1 cfs, with variable flows diverted from Oak Creek.
Additionally, the property includes a permitted well that is 109 years old. Due to a rusted-through steel casing and partial collapse, the well is currently unusable.
