PHILLIP R. GARBIG, SUCCESSOR TRUSTEE OF THE LAVAUN YOHE REVOCABLE TRUST DATED JANUARY 13, 2023

Phillip R. Garbig, Successor Trustee of the Lavaun Yohe Revocable Trust dated January 13, 2023, owner shall offer at private sale by sealed bid 92.729 acres more or less of agricultural ground, in "AS IS" condition, located at the northwest corner of State Route 49 and Gettysburg-Pitsburg Road (approximately ¼ mile south of Pitsburg, Ohio, Monroe Township Darke County, Ohio, Parcel I.D. K39-0-308-12- 00-00-204-01 (69.229 acres), K39-0-308-13-00-00-101-00 (23.000 acres) and K39-0-308-13-00-00-107-00 (0.500 acres).
Said sealed bids may be delivered to the Law Office of Garbig, Schmidt & Pohlman, LLC until Friday, November 13, 2025 at 5:00 p.m. Ohio time. Bidder must clearly set forth his/her bid in a total dollar amount. As there will be no raising of bids, bidders should submit his/her highest and best bid.
Owner reserve the right to accept or reject any or all bids.
If a bid is accepted, the successful bidder shall enter into a contract with the owner, with no contingencies and make a non-refundable earnest money deposit of $50,000.00. The balance of the purchase price shall be due and payable upon delivery of Trustee's Deed from owner by no later than December 15, 2025.
All real estate taxes and assessments, if any, for the year in which the closing takes place shall be pro-rated to the closing date using the short form tax proration method based upon the most recent real estate tax bill for the subject real property and paid by owner. Such proration shall be final, and after such proration is made the successful bidder shall be responsible for paying all installments of such taxes and assessments becoming due and payable thereafter, including CAUV recoupment costs, if any.
Possession shall be given at closing upon delivery of Trustee's Deed.
